     The hosting services must not be used for unlawful purposes. Any use of these services which violates any local, state, federal or international laws applicable to (1300WEBSPACE) Starhosting, any jurisdiction that your site is subject to is strictly prohibited

     You agree that use of our services is at your own risk. The services are provided by (1300WEBSPACE) Starhosting on an "AS IS" and "AS AVAILABLE" basis. (1300WEBSPACE) Starhosting expressly disclaims all warranties of any kind,

     (1300WEBSPACE) Starhosting reserves the right to take action, including legal or suspension of or termination of a service, against a customer who interferes with the rights of another user online, or attempts to interfere with the smooth running of the internet or (1300WEBSPACE) Starhosting services. We reserve the right to discontinue, without refund or notice, any account or service where usage of the account or service is deemed to be an abuse, and we will charge the customer for costs incurred by any such abuse.

     (1300WEBSPACE) Starhosting does not tolerate SPAM. If you use Spam, unsolicited emails or message board posting, then your access to our services will be immediately terminated

     You accept legal responsibility for use of the account, are at least 18 years of age or (if younger) have your parent's or legal guardian's permission before using our services

     Your access to all or part of our services may be denied without notice if (1300WEBSPACE) Starhosting believes any of the terms and conditions have been violated.

     (1300WEBSPACE) Starhosting will automatically rebill a customer's credit card, where credit card details have been provided unless otherwise informed.

     You are responsible for any misuse of our services, even for example, if the misuse was committed by a friend, family member, guest, employee or customer with access to your account or website. You are also responsible for any such misuse regardless of whether it was with or without your consent. Therefore, you must take steps to ensure that others do not gain unauthorized access to your account or website.

Abusing or disregarding our rules can result in degradation of our servers performance which affects all of our customers. All services provided by (1300WEBSPACE) Starhosting may be used for lawful purposes only. Transmission, storage or presentation of any information, data or material in violation of any government law is prohibited. This includes, but is not limited to,copyrighted material, material we judge to be threatening or obscene or material protected by trade secret or other statute. You, as the customer, agree to indemnify and hold harmless (1300WEBSPACE) Starhosting from any claims resulting from the use of the service that damages the customer or any other party. The following are examples of unacceptable uses of (1300WEBSPACE) Starhosting services; Unacceptable Content

All pornographic content and sex-related merchandising is prohibited on all (1300WEBSPACE) Starhosting servers. This includes sites that may infer sexual content or links to adult content elsewhere. (1300WEBSPACE) Starhosting will be the sole arbiter in determining violations of this provision. Also prohibited are sites that promote any illegal activity or present content that may be damaging to (1300WEBSPACE) Starhosting servers or any other server on the . Links to such materials are also prohibited. Examples of unacceptable content or links: - Pirated software - Hacker programs or archives - Warez sites - (1300WEBSPACE) Starhosting will be the sole arbiter as to what constitutes a violation of this provision.


 Unsolicited emailing (Spam)

 

Spamming, or the sending of unsolicited e-mail, from a (1300WEBSPACE) Starhosting server or using an e-mail address or domain that is maintained on a (1300WEBSPACE) Starhosting machine as reference is STRICTLY prohibited. Spoofing (using a return e-mail address which is not the valid reply address of the sender or sending an e-mail message which does not contain enough information to enable the recipient to identify the party who is really sending the message, passive spamming (promoting a web site hosted by (1300WEBSPACE) Starhosting by spamming from some other source), trolling (posting controversial messages in newsgroups to generate responses), mail bombing (inundating a user with e-mail without any serious intent to correspond), and subscribing someone else to an electronic mailing list without that person's permission are also prohibited. It is a violation of our policy to possess on our servers any such software or program that is or may be used for such purposes. Furthermore, if an attempt is made to cause harm to another person's or organization's server, using our servers, your account will be terminated immediately. In addition, any and all information regarding the violation, and your account in general, will be turned over to the proper authorities for prosecution. (1300WEBSPACE) Starhosting will be the sole arbiter as to what constitutes a violation of this provision. Accounts that are found relaying spam will be terminated immediately and the owner of the account will be charged $200.00 AUD per spam item.

 

Bandwidth Overages

 

Overages are not tolerated at (1300WEBSPACE) Starhosting. If your account exceeds its monthly transfer quota, you must upgrade to a package that will accommodate your bandwidth needs. (1300WEBSPACE) Starhosting does not allow for fees for overages. If you are over your quota, you must upgrade to a package that will ensure that you will not exceed your monthly bandwidth quota. The new package can either be an existing package, or one customized for you by (1300WEBSPACE) Starhosting . (1300WEBSPACE) Starhosting reserves sole discretion on the pricing of custom bandwidth packages. Customers who do not comply with these terms are subject to immediate account termination.


 Abuse of Rights of Others

 

Examples of unacceptable activities in this regard include but are not limited to, posting private information about a person without their consent, infringing intellectual property rights, defaming a person or business, and knowingly making available code which will have a deleterious effect on third party computers or programs. (1300WEBSPACE) Starhosting supports free speech on the Internet, and will not suspend or cancel a customer?s account simply because it disagrees with the views expressed by the customer. Where there are allegations that a customer?s on-line activity has violated the legal rights of a third party, (1300WEBSPACE) Starhosting will be the sole arbiter as to what constitutes a violation of this provision.


 Copyright Infringement

 

(1300WEBSPACE) Starhosting supports copyright laws. Accordingly, we reserve the right to cancel your account if your site is found to be violating local, national, or international copyright laws. (1300WEBSPACE) Starhosting will be the sole arbiter as to what constitutes a violation of this provision. IRC IRC or IRC bots may not be operated on our servers at this time. (1300WEBSPACE) Starhosting will be the sole arbiter as to what constitutes a violation of this provision.

 

Server Abuse

 

Any attempt to undermine or cause harm to a server or customer of (1300WEBSPACE) Starhosting is strictly prohibited and is subject to immediate account termination. (1300WEBSPACE) Starhosting will be the sole arbiter as to what constitutes a violation of this provision. Violators will be prosecuted to the fullest extent of the law. Refusal of Service We reserve the right to refuse, cancel or suspend service at our sole discretion.


 Limitation of Liability

 

(1300WEBSPACE) Starhosting shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from (1300WEBSPACE) Starhosting servers going off-line or being unavailable for any reason whatsoever. Further, (1300WEBSPACE) Starhosting shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of (1300WEBSPACE) Starhosting servers. It is each clients responsibility to keep a working copy of all your files on your hard drive in the unlikely event that your account is deleted or lost. (1300WEBSPACE) Starhosting shall be the sole arbiter of what is and is not a violation of these acceptable usage policies. In addition (1300WEBSPACE) Starhosting reserves the right to terminate an account at any time and for any reason that we feel is prudent and in the best interest of our company Customers who violate our Acceptable Use Policy (AUP), may, at our discretion, be subjected to account suspension or deletion. Violation of these terms can also result in criminal prosecution in some cases. If your account is cancelled for violations of any of these policies, you will not receive a refund of your monthly/yearly fee.


Back-up Your Information and Retrieve Your Email First

Be sure you have backed up of all your account information before you issue your cancellation request. We are not responsible for any of your account information after you notify us to cancel your account. This information includes, but is not limited to, your web site and any email left on your account.

All account cancellation requests must be via account cancellation form; account cancellations submitted via fax, phone, e-mail or the help desk will not be accepted or considered valid unless e-mailed by a staff member.

Please use the form below to cancel your hosting account. All fields are mandatory and cancellations can take up to 3-5 business days to process. All Sales are Final; we do not issue refunds if your account is over 30 days old as per our policies.


If your account is 30 days old or less, you are entitled to a refund under our 30 Day Money Back Guarantee. Your prepaid hosting fees will be refunded to your credit card on file within 1-2 weeks of this request. Setup fees or domain registration charges are always non-refundable.


Terms and Conditions Price Matching


- Competing Hosting Plan must offer equal or greater features than Starhosting / 1300WEBSPACE Plans. For example, hosting plans offering less than 50 MB of space will not be considered.


- Competing Web Hosts must not offer Unlimited Bandwidth or Unlimited Space. A general rule of thumb is to stay away from these companies. For more information on why Starhosting / 1300WEBSPACE does not believe in "unlimited" features, feel free to contact our Sales Team.


- Free Web Hosts or companies that place banner advertising on your pages will not be considered.

- Starhosting / 1300WEBSPACE reserves the right to NOT match the competing host for any reason what so ever.
